Jeliko\u017e se dotazy \u010dasto opakuj\u00ed, vybrali jsme pro v\u00e1s ty nej\u010dast\u011bj\u0161\u00ed, a to z oblasti pracovn\u00edho pr\u00e1va. A\u0165 u\u017e jste teda zam\u011bstnavatel nebo zam\u011bstnanec a po\u0159\u00e1d v tom nem\u00e1te \u00fapln\u011b jasno, uva\u0159te si karant\u00e9nn\u00ed kafe, dokud je\u0161t\u011b je, a v klidu si projd\u011bte co jsme zjistili, \u017ee v\u00e1s nej\u010dast\u011bji tr\u00e1p\u00ed. <\/p>\n\n\n\n<h4> 1. M\u016f\u017ee b\u00fdt zam\u011bstnanci zam\u011bstnavatelem na\u0159\u00edzena dovolen\u00e1 s okam\u017eitou platnost\u00ed? <\/h4>\n\n\n\n<p> Ne, ani v sou\u010dasn\u00e9 krizov\u00e9 situaci nem\u016f\u017ee b\u00fdt zam\u011bstnanci jednostrann\u011b na\u0159\u00edzena dovolen\u00e1 s p\u0159edstihem krat\u0161\u00edm ne\u017e 14 dn\u00ed. Okam\u017eit\u00e1 dovolen\u00e1 nen\u00ed probl\u00e9m, pokud se na n\u00ed zam\u011bstnanec se zam\u011bstnavatelem dohodnou, jinak n\u00e1le\u017e\u00ed zam\u011bstnanci a\u017e do doby ne\u017e bude mo\u017en\u00e9 jednostrann\u011b na\u0159\u00eddit dovolenou n\u00e1hrada mzdy ve v\u00fd\u0161i 100 % pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku. <\/p>\n\n\n\n<h4> 2. M\u016f\u017ee zam\u011bstnanec odm\u00edtnout p\u0159ij\u00edt do pr\u00e1ce? <\/h4>\n\n\n\n<p> Dle z\u00e1kon\u00edku pr\u00e1ce m\u016f\u017ee zam\u011bstnanec odm\u00edtnout v\u00fdkon takov\u00e9 pr\u00e1ce, u kter\u00e9 m\u00e1 za to, \u017ee p\u0159\u00edmo ohro\u017euje jeho \u017eivot nebo zdrav\u00ed. M\u00e1me za to, \u017ee prozat\u00edm tato podm\u00ednka v p\u0159\u00edpad\u011b obavy z naka\u017een\u00ed koronavirem napln\u011bna nebyla. Pokud tedy zam\u011bstnanec nep\u0159ijde do pr\u00e1ce, jedn\u00e1 se o neomluvenou absenci, kterou m\u016f\u017ee zam\u011bstnavatel postihnout. Doporu\u010dujeme se sna\u017eit se zam\u011bstnanci rozumn\u011b domluvit na mo\u017enostech (home office, dovolen\u00e1, neplacen\u00e9 volno). M\u00e1m d\u011bti a jejich \u0161kola\/\u0161kolka byla uzav\u0159ena, co m\u00e1m d\u011blat a na co m\u00e1m n\u00e1rok? <\/h4>\n\n\n\n<p> V t\u00e9to situaci by v\u00e1m mohl pomoci institut o\u0161et\u0159ovn\u00e9ho. O\u0161et\u0159ovn\u00e9 na d\u00edt\u011b lze \u010derpat v maxim\u00e1ln\u00ed d\u00e9lce 9 dn\u00ed, resp. 16 dn\u00ed pokud jde o osam\u011bl\u00e9ho zam\u011bstnance, a to na d\u00edt\u011b ve v\u011bku do 10 let, resp. 16 let, op\u011bt v p\u0159\u00edpad\u011b osam\u011bl\u00e9ho zam\u011bstnance. P\u0159esn\u00e9 podm\u00ednky a v\u00fdjimky z n\u00e1roku na o\u0161et\u0159ovn\u00e9 jsou pak podrobn\u011b rozeps\u00e1ny v \u00a7 39 z\u00e1kona o nemocensk\u00e9m poji\u0161t\u011bn\u00ed. V sou\u010dasn\u00e9 sob\u011b se jedn\u00e1 o prodlou\u017een\u00ed doby o\u0161et\u0159ovn\u00e9ho na celou dobu trv\u00e1n\u00ed uzav\u0159en\u00ed \u0161kol a zaveden\u00ed p\u0159\u00edsp\u011bvku i pro OSV\u010c, nicm\u00e9n\u011b zat\u00edm nedo\u0161lo ke schv\u00e1len\u00ed t\u011bchto zm\u011bn. Tiskopis s \u017e\u00e1dost\u00ed o o\u0161et\u0159ovn\u00e9 je voln\u011b dostupn\u00fd na internetu. \u010c\u00e1st A vypl\u0148uje p\u0159\u00edmo uzav\u0159en\u00e1 \u0161kola\/\u0161kolka (lze po\u017e\u00e1dat i o jeho vypln\u011bn\u00ed na d\u00e1lku a zasl\u00e1n\u00ed ne e-mail rodi\u010de). \u010c\u00e1st B pak vypl\u0148uje s\u00e1m rodi\u010d a ten pak nej\u010dast\u011bji podepsan\u00fd a naskenovan\u00fd pos\u00edl\u00e1 e-mailem zam\u011bstnavateli, kter\u00fd vypln\u00ed \u010d\u00e1st C formul\u00e1\u0159e a kompletn\u00ed formul\u00e1\u0159 pak s podklady pro v\u00fdpo\u010det o\u0161et\u0159ovn\u00e9ho za\u0161le na p\u0159\u00edslu\u0161nou Okresn\u00ed spr\u00e1vu soci\u00e1ln\u00edho zabezpe\u010den\u00ed. Pokud zam\u011bstnanec po dobu o\u0161et\u0159ov\u00e1n\u00ed \u010dlena rodiny nepracuje (nap\u0159\u00edklad na home office), nen\u00e1le\u017e\u00ed mu vedle o\u0161et\u0159ovn\u00e9ho \u017e\u00e1dn\u00e1 n\u00e1hrada mzdy ani mzda samotn\u00e1. <\/p>\n\n\n\n<h4> 4. Jak\u00e9 m\u00e1m jako zam\u011bstnavatel mo\u017enosti\/povinnosti ve vztahu k zam\u011bstnanc\u016fm pokud mus\u00edm zav\u0159\u00edt z d\u016fvodu vl\u00e1dn\u00edho na\u0159\u00edzen\u00ed? <\/h4>\n\n\n\n<p> Tato situace se posuzuje jako p\u0159ek\u00e1\u017eka v pr\u00e1ci na stran\u011b zam\u011bstnavatele a zam\u011bstnanci tak n\u00e1le\u017e\u00ed n\u00e1hrada mzdy v pln\u00e9 v\u00fd\u0161i jeho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku. Tato varianta je v\u0161ak pro spoustu zam\u011bstnavatel\u016f finan\u010dn\u011b n\u00e1ro\u010dn\u00e1, a proto je mo\u017enost a je vhodn\u00e9 se domluvit na n\u011bjak\u00e9m \u0159e\u0161en\u00ed, kter\u00e9 nebude likvida\u010dn\u00ed ani pro jednu stranu. M\u016f\u017ee se jednat nap\u0159\u00edklad o home office, \u010derp\u00e1n\u00ed dovolen\u00e9 \u010di neplacen\u00e9 volno. <\/p>\n\n\n\n<h4> 5. Jak\u00e9 m\u00e1m jako zam\u011bstnavatel mo\u017enosti\/povinnosti ve vztahu k zam\u011bstnanc\u016fm pokud mus\u00edm zav\u0159\u00edt z d\u016fvodu sn\u00ed\u017een\u00ed popt\u00e1vky po slu\u017eb\u00e1ch \u010di odbytu zbo\u017e\u00ed? <\/h4>\n\n\n\n<p> V tomto p\u0159\u00edpad\u011b se jedn\u00e1 o tzv. \u010d\u00e1ste\u010dnou nezam\u011bstnanost. V p\u0159\u00edpad\u011b, \u017ee u zam\u011bstnavatele nep\u016fsob\u00ed odbory, vyd\u00e1 zam\u011bstnavatel vnit\u0159n\u00ed p\u0159edpis a m\u016f\u017ee sn\u00ed\u017eit zam\u011bstnanci mzdu a\u017e na 60%. V p\u0159\u00edpad\u011b, \u017ee u zam\u011bstnavatele p\u016fsob\u00ed odbory, mus\u00ed s nimi zam\u011bstnavatel jednat o v\u00fd\u0161i tohoto sn\u00ed\u017een\u00ed -&gt; v\u00fdsledkem jedn\u00e1n\u00ed mus\u00ed b\u00fdt dohoda o v\u00fd\u0161i sn\u00ed\u017een\u00ed. \u010c\u00e1ste\u010dn\u00e1 nezam\u011bstnanost se v p\u0159\u00edpad\u011b, kdy\u017e u zam\u011bstnavatele nep\u016fsob\u00ed odbory, nemus\u00ed hl\u00e1sit na \u00fa\u0159ad pr\u00e1ce a posta\u010d\u00ed pouze vyd\u00e1n\u00ed ji\u017e zm\u00edn\u011bn\u00e9ho vnit\u0159n\u00edho p\u0159edpisu. <\/p>\n\n\n\n<h4> 6. Co kdy\u017e byla m\u00e9mu zam\u011bstnanci na\u0159\u00edzena karant\u00e9na? <\/h4>\n\n\n\n<p> Pokud m\u00e9mu zam\u011bstnanci byla l\u00e9ka\u0159em na\u0159\u00edzena karant\u00e9na, jeliko\u017e se vr\u00e1til z rizikov\u00e9 oblasti, p\u0159i\u0161el do kontaktu s naka\u017eenou osobou \u010di vykazuje zn\u00e1mky onemocn\u011bn\u00ed, jedn\u00e1 se o stejn\u00fd re\u017eim jako v p\u0159\u00edpad\u011b nemocensk\u00e9. Za prvn\u00edch dn\u00ed n\u00e1le\u017e\u00ed zam\u011bstnanci n\u00e1hrada mzdy ve v\u00fd\u0161i 60 % jeho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku, kterou plat\u00ed zam\u011bstnavatel a po uplynut\u00ed t\u011bchto 14 dn\u00ed u\u017e zam\u011bstnanci plat\u00ed d\u00e1vky st\u00e1t ze syst\u00e9mu nemocensk\u00e9ho poji\u0161t\u011bn\u00ed. Jako p\u0159\u00edloha tohoto na\u0159\u00edzen\u00ed je \u010destn\u00e9 prohl\u00e1\u0161en\u00ed zam\u011bstnance o jeho zdravotn\u00edm stavu, kter\u00e9 tyto prohl\u00eddky po dobu nouzov\u00e9ho stavu nahrazuje. <\/p>\n\n\n\n<h4> 9. Mus\u00ed zam\u011bstnavatel zam\u011bstnanc\u016fm, u kter\u00fdch je to mo\u017en\u00e9, umo\u017enit pr\u00e1ci z domu (home office)? A naopak, lze home office zam\u011bstnanc\u016fm jednostrann\u011b na\u0159\u00eddit? <\/h4>\n\n\n\n<p> Ne, neexistuje prozat\u00edm z\u00e1konn\u00e1 povinnost zam\u011bstnavatele umo\u017enit zam\u011bstnanci pr\u00e1ci z domu, jeliko\u017e zam\u011bstnanec je za z\u00e1kona povinen vykon\u00e1vat pr\u00e1ci na m\u00edst\u011b sjednan\u00e9m se zam\u011bstnavatelem. \u017d\u00e1dn\u00e9 na\u0159\u00edzen\u00ed ukl\u00e1daj\u00edc\u00ed zam\u011bstnavatel\u016fm povinnost umo\u017e\u0148ovat home office nebylo doposud p\u0159ijato. Rovn\u011b\u017e plat\u00ed, \u017ee home office nelze zam\u011bstnanci jednostrann\u011b na\u0159\u00eddit, ale je pot\u0159eba, aby s n\u00edm zam\u011bstnanec souhlasil. <\/p>\n\n\n\n<h4> 10. M\u016f\u017ee zam\u011bstnavatel zam\u011bstnance v souvislosti s nedostatkem pr\u00e1ce z d\u016fvodu pandemie p\u0159ev\u00e9st na jinou pr\u00e1ci? <\/h4>\n\n\n\n<p> V p\u0159\u00edpad\u011b prostoj\u016f na stran\u011b zam\u011bstnavatele (nedorazil materi\u00e1l na v\u00fdrobu apod.) za situace, kdy zam\u011bstnavatel m\u00e1 pro zam\u011bstnance jinou pr\u00e1ci, mus\u00ed zam\u011bstnanec s p\u0159eveden\u00edm na tuto jinou pr\u00e1ci souhlasit.
